1)Internet Applicant/Veterans Trends
Mickey Silberman, Esq., Jackson Lewis, LLP
Strategic Applicant Tracking and Reducing Adverse Impact: Using the
Internet Applicant Rule to Reduce Your Recordkeeping Burden and Your
Company's Exposure to Claims of Discrimination
The Internet Applicant Rule is now more than two years old. While
most employers have implemented the Rule, many have not taken full
advantage of the strategic benefits it offers. And the consequences
are real: more OFCCP applicant discrimination claims and larger
back-pay settlements than ever before. In this session, learn about
the best practices that have evolved over the past few years to
substantially reduce your applicant tracking and record-keeping
burden and minimize your exposure to applicant discrimination claims
during OFCCP audits. Also, learn about the changed Veterans
reporting obligations and simple, practical ways to comply.
2) Alternative Dispute Resolution

P.C.
Katherine Cooper Franklin, Esq., Littler Mendelson, P.C.
J. Kevin Lilly, Esq., Littler Mendelson, P.C.
Alternative
dispute resolution (ADR), when used properly in appropriate
circumstances, can provide faster, less expensive, less
contentious, and more productive results in resolving conflict in
the workplace, including claims of discrimination, harassment,
retaliation and other employment related issues. The workshop will
provide effective techniques and tools for success at mediation and
give participants a chance to see a mock mediation session in
action.

and answer some of those questions.
4)OFCCP Workshop
Dr. Javaid Kaiser, PhD, Director of Statistical Analysis, OFCCP
OFCCP: An Overview of Statistical Applications
Statistical procedures can uncover underlying patterns and trends in
data that traditional investigative tools may not find or would
require prohibitive amounts of resources and time. The advancement
in technology has provided breakthroughs in analyzing data in the
most unbiased and cost effective manner. This session will provide a
discussion of a few statistical procedures that seem beneficial to
the business community for self-evaluation of employment data.
5)Aging & Workplace Flexibility
Dr. Marcie Pitt-Catsouophes, Co-Director of the Center for Aging &
Work at Boston College
The 21St Century Multi Generational Workforce

emerging in Wage and Hour claims currently sweeping the country.

Kathleen
Mulligan, Administrative Law Judge, Equal Employment Opportunity
Commission, Los Angeles District Office
Managing
Converging Issues in the 21st Century Workplace
What circumstances constitute unlawful and disparate treatment under
Title VII and/or the Americans with Disabilities Act against a
worker with care giving responsibilities? The discussion will focus
on a number of issues such as sex based stereotypes, disparate
treatment of pregnant workers, women of color with care giving
responsibilities, workers providing care to individuals with
disabilities and much more.
2)Transgender Inclusion
Margaret Stumpp, Chief Investment Officer, Quantitative Investment Management Associates
Understanding Transgender Inclusion – An Emerging Dimension in
Workplace Diversity
Transsexual people increasingly are attempting to openly transition
from male to female or female to male and remain in the same job.
This has spurred employer interest in understanding and addressing
transgender issues to effectively support this emerging dimension in
workplace diversity. A personal story will be shared to help gain
more insight and perspective.
3)OFCCP Workshop
Dr. Richard Fischer, Government’s
Psychometric Expert OFCCP
OFCCP: Tests and Their Impact on Selection
The “testing portion” of a compliance evaluation looks at
contractors’ high-stakes tests and selection practices.
“High-stakes” means that examinees failing the test won’t get
something they want - like a job or a credential - and so OFCCP’s
review of contractor tests is an important part of the compliance
evaluation. If a test has adverse impact, the case goes to OFCCP
testing expert, Richard Fischer.
Join Dr. Fischer for a look at the testing part of a compliance
evaluation, including non-technical review of concepts like validity
and, why a test is discriminatory; test-related information OFCCP is
looking for during the review; and why a test without acceptable
validation is not really identifying the best candidates – legal
issues aside.
4)OFCCP Workshop
Regional Directors Round Table
“Let’s Talk”
Don’t miss
this annual forum that will gather the OFCCP Regional Directors for
an informative dialogue on hot topics and questions of emerging

to service members severely injured in the Global War on Terrorism
and helps them identify career opportunities within Northrop
Grumman. The company was recognized with the U.S. Secretary of
Labor's sixth annual New Freedom Initiative award for its program,
“Operation IMPACT” (Injured Military Pursuing Assisted Career
Transition) program.
6)The Next Generation of New Leaders
Bruce Tulgan, Founder & Chairman, RainmakerThinking, Inc.™
New Leaders: Developing the Next Generation
The latest business dilemma facing organizations across the country
is the leadership crisis. On the one hand, aging workers will be
retiring in large numbers over the next ten years, leaving behind a
growing number of leadership vacancies. On the other hand, fewer
talented young workers are willing to follow the old-fashioned
career paths that guaranteed leadership succession in the workplace
of the past. This presentation will help you address and solve the
leadership crisis in your organization. It offers business leaders,
human resource professionals, and emerging leaders themselves new
ways to think about leadership and new ways to prepare the next
generation for leadership roles.
12:00 pm – 1:30 pm Lunch
Keynote Speaker: The Honorable
Neil Romano, Assistant Secretary, Office of Disability Employment
Policy, U.S. Dept. of Labor

OFCCP: Understanding Defenses
from the Perspective of OFCCP (Afternoon Only)
Are you paying big money for defenses that just don't work? We can't
be discriminators; we are utilized above availability. Your findings
aren't practically significant because if you shift the identity of
two affected class hires to two favored group hires, our standard
deviations drop below two. Your shortfall brings the standard
deviations to zero so it can't be right. Etc. etc. etc.
Learn about the ten often raised, but unpersuasive, arguments you
should avoid in defending systemic discrimination findings. Know
when to tell your advisors Don't Go There!

Diversity Principles: Strategic Integration
The population, here and abroad, has never been more diverse than it
is today! And as the population continues to diversify, so too does
the marketplace and the workplace. Companies that employ diversity
as a business strategy for both the top and bottom lines, realize
higher productivity, operational efficiencies, and overall
profitability. The New Zealand Herald reports “...organizations with
a diverse employee base yield a shareholder return that is 12.4%
higher than their counterparts.”
This power-packed presentation examines world class organizations
and the process each journeys through when integrating diversity as
a business strategy. In this high energy session – tactics for
measuring outcomes aligned with the diversity strategy, leading
organizational change, building a high performance diversity
council, and creating a retention infrastructure which retains only
employees who provide customer solutions – are a few of the
immediate take-aways to implement today!
