The “testing portion” of a compliance evaluation looks at contractors’ high-stakes tests and selection practices. “High-stakes” means that examinees failing the test won’t get something they want - like a job or a credential - and so OFCCP’s review of contractor tests is an important part of the compliance evaluation. If a test has adverse impact, the case goes to OFCCP testing expert, Richard Fischer.

Join Dr. Fischer for a look at the testing part of a compliance evaluation, including non-technical review of concepts like validity and, why a test is discriminatory; test-related information OFCCP is looking for during the review; and why a test without acceptable validation is not really identifying the best candidates – legal issues aside.
